Terms of Service

Version 1.2 · Effective 12 October 2026

In short

  • SafeMeal helps you tell a kitchen what you cannot eat. It cannot know what is in a dish, and it does not make any meal safe.
  • Always confirm with the staff, read labels, and carry the emergency medication your doctor prescribed. SafeMeal is not a medical device and gives no medical advice.
  • Translations and food information are prepared with care but can be incomplete or wrong. Check your card before you rely on it.
  • SafeMeal is paid. You can choose a yearly subscription, which starts with a free trial and renews until you cancel it in your App Store or Google Play account, or a one-time lifetime purchase.
  • We receive your profiles only if you sign in to back them up or share a link. You can delete your account in the app at any time.
  • If you live in the EU, the UK or another country with consumer protection laws, you keep all the rights those laws give you.
  • If you live in the United States, disputes are resolved by individual arbitration, not in court or in a class action, unless you opt out within 30 days (section 18.3).

This summary helps you read the Terms. It does not replace them.

1. Agreement

These Terms of Service (the “Terms”) are a contract between you and Moty Studio LLC, a limited liability company organized under the laws of Wyoming, United States (“Moty Studio”, “we”, “us”). They apply to the SafeMeal mobile app, its home-screen widgets, the shared card pages and the website at safemeal.app (together, “SafeMeal”).

By installing, opening or using SafeMeal, or by tapping a button that refers to these Terms, you agree to them. If you do not agree, do not use SafeMeal.

Our Privacy Policy and our Consumer Health Data Privacy Policy explain how we handle your information. They are part of how we provide SafeMeal, but they are not a contract you sign: they describe our practices and your rights.

The terms of the app store you downloaded SafeMeal from (Apple App Store or Google Play) also apply to your download and to your purchases.

2. Important safety information

SafeMeal is a communication aid. It is not a safety guarantee, a medical device or a source of medical advice.

SafeMeal shows restaurant staff, in their language, the foods you have chosen to avoid. It cannot know what is in a dish, how it was prepared, what a supplier put in an ingredient, or whether the staff read, understood or followed your card. Food allergies can cause severe and life-threatening reactions, and no app can remove that risk.

Before you eat, always:

  • confirm with the staff that your food is safe for you, and do not eat it if you are in any doubt;
  • read ingredient labels when they are available;
  • carry the emergency medication your doctor prescribed (for example an adrenaline/epinephrine auto-injector) and follow your emergency plan;
  • follow the advice of your doctor or allergist, which always comes before anything shown in SafeMeal.

In an emergency, call the local emergency number at once. Do not use SafeMeal to decide whether you need medical help.

What the information in SafeMeal is, and what it is not. The catalog of foods, the translations, the card phrases, the “Also includes” lists and the “Often hidden in” dishes are prepared with care by our team, with the help of research, professional tools and machine translation. They are general information to help you communicate. In particular:

  • Translations can be wrong or unclear. Most of them were produced with machine translation and checked with automated tools, and some by our team; most have not been checked by a native speaker of the language. Words for foods vary between regions and dialects, and staff may not read the language or script shown. Each food is followed by its English name so that you and the staff can check it; the severity badge and the kitchen precautions are shown in the card’s language only.
  • Lists are never complete. “Also includes” and “Often hidden in” give examples of forms and dishes to ask about. A food or dish that is not listed may still contain what you avoid. Recipes vary from one kitchen to the next.
  • The catalog may not contain every food or ingredient you need to avoid. If something is missing, tell the staff directly, and you can ask us to add it.
  • The severity levels (severe allergy, strict, preference) and the kitchen precautions on the card are labels you choose to tell the kitchen how careful to be. They are not a medical assessment.
  • SafeMeal does not diagnose, treat, cure, monitor or prevent any disease or condition, and it is not intended to be used for any medical purpose.

If you find an error in a translation or in a food’s information, please tell us from the app (“Need help?”) or at [email protected], so that we can fix it for everyone.

Your responsibility. You decide what you eat and what you let others eat. You are responsible for keeping your profiles accurate and up to date, for checking your card before you rely on it, and for confirming with the staff every time. If you create a profile for a child or for another person, you are responsible for its accuracy and for supervising how it is used.

3. Who can use SafeMeal

You must be at least 16 years old to use SafeMeal, and old enough to enter into a contract where you live (or have the permission of your parent or legal guardian, who then accepts these Terms for you and is responsible for your use). A parent or guardian may create profiles for their children and show their cards for them; the child does not use the app.

You may not use SafeMeal if you are barred from doing so under the laws that apply to you.

4. What SafeMeal does

SafeMeal lets you:

  • create one or more food profiles listing the foods you cannot eat and how strict the kitchen must be;
  • show a restaurant card of a profile in the language of the country you are in, or in another language you pick, with the English name under each food;
  • see the “Also includes” and “Often hidden in” information of each food;
  • share a profile’s card with a link or a QR code, and export it as an image;
  • back up your profiles to an account (Google or Apple sign-in);
  • show your card on home-screen widgets;
  • contact us for help or ask us to add a food.

Once your card and its languages have been downloaded, the card works offline. Choosing foods, changing languages for the first time, sharing, backing up and contacting us need an internet connection.

We improve SafeMeal over time: we may add, change or remove features, foods, translations and languages. We will not remove a feature that is essential to the paid service you bought without telling you in advance (section 13).

5. Your profiles and the people in them

The profiles you create are your content. By default they are stored on your device, and in your phone’s own backups if you use them (run by Apple, Google or your phone’s maker; we have no access to them). Apart from those backups, they leave your device only when you choose to:

  • sign in, which backs up your profiles to your account (with your explicit consent, which the app asks for);
  • share a link, which publishes a copy of that profile’s foods and severity (never its name) at a secret address;
  • export an image and send it, or contact us and include information in your message.

If you enter information about another person (for example a family member), you confirm that you are allowed to do so, that it is accurate to the best of your knowledge, and, where the law requires it, that you have their consent or are their parent or guardian.

To provide SafeMeal, you allow us to store, copy, process and display the content you choose to back up, share or send to us, only as needed to provide, secure and support SafeMeal and as described in our Privacy Policy. We do not sell it and we do not use it for advertising.

6. Your account

You can use SafeMeal without an account: the app creates a random technical identifier for your purchases, so that they can be restored. You can sign in with Google or Apple to back up your profiles and use them on another device.

You are responsible for the security of the device and the Google or Apple account you use with SafeMeal. Tell us at once at [email protected] if you believe someone else is using your account.

You can delete your account at any time from the app’s Settings, or by following the steps on our account deletion page. Deleting your account deletes the profiles backed up to it, the links you shared and the other data linked to it, as described in our Privacy Policy. The profiles stored on your phone stay there until you delete them or uninstall the app, and their copies in your phone’s own backups are managed in its settings. It does not cancel a subscription: cancel it in your App Store or Google Play account (section 7).

7. Subscriptions and purchases

7.1 What you pay for

SafeMeal is free to download. Using it beyond the first setup requires one of the following (the “paid service”), offered inside the app:

  • a yearly subscription that renews automatically (the “subscription”); or
  • a lifetime purchase: one payment, no renewals.

The price, the currency, the length of any free trial and what is included are shown in the app and by the app store before you confirm. Prices may differ between countries and stores and may include taxes required by local law.

7.2 Payment by the app store

All purchases are made through, and paid to, Apple (App Store) or Google (Google Play). The store processes your payment under its own terms; we never see or store your card details. We use a service provider, RevenueCat, to check which purchases your app is entitled to.

7.3 Free trial

When a free trial is offered, it is for new subscribers only, as determined by the app store (usually one trial per store account). At the end of the trial, the subscription starts and you are charged automatically, unless you cancel at least 24 hours before the trial ends. Buying the lifetime option does not cancel a trial or a subscription: the app store keeps it running, so cancel it in your App Store or Google Play account settings (the app reminds you and takes you there), or it will be charged.

7.4 Automatic renewal and cancellation

  • Payment is charged to your app store account when you confirm the purchase or, if you started with a free trial, when the trial ends.
  • The subscription renews automatically for another year at the then-current price unless you cancel it at least 24 hours before the end of the current period. Your store account is charged for the renewal within the 24 hours before the period ends.
  • You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the app or your SafeMeal account does not cancel it. After you cancel, you keep access until the end of the period you paid for.
  • If the price of the subscription changes, the app store will tell you in advance and, where its rules or the law require it, ask for your agreement before the new price applies.

7.5 Lifetime purchase

A lifetime purchase gives you access to the paid service, on the platforms where we offer it, for as long as we provide SafeMeal, without renewal fees, including the updates we release to it. “Lifetime” refers to the life of the app, not of a person. It does not guarantee that a particular feature, food or language will remain available forever, but we will not take away the core of what you bought (showing your card in the languages we support) while we provide SafeMeal.

7.6 Refunds and withdrawal

Refunds are handled by the app store under its own rules: request them from Apple (reportaproblem.apple.com) or Google Play. If you are a consumer in the European Union, the United Kingdom or another country that gives you a right to withdraw from a purchase (usually within 14 days), you can exercise it through the store, which processes withdrawals and refunds for us. Nothing in these Terms limits your statutory rights.

7.7 Restoring purchases

Your purchase is linked to the store account you used. On a new device, use “Restore purchases” in the app, or sign in to the same SafeMeal account. A purchase made on one platform (iOS or Android) may not be available on the other.

8. Shared links and exported images

When you share a profile, anyone who has the link or the QR code can see its card (the foods and the severity, never the profile’s name), without the app and without signing in. The link always shows the latest backed-up version. You can change the link (the old one stops working) or turn it off at any time. Exported images are copies you control: once you send one, we cannot take it back.

You are responsible for whom you share your cards with. Only share another person’s card with their permission.

Reporting content. If you believe a shared card or other content on SafeMeal is illegal, write to [email protected] with the subject “Report”, the link to the content and the reason. We review every report promptly and tell you what we decided. If we remove content or restrict an account, we tell the person concerned why (section 14), and they can contest the decision by replying to us.

9. Support, food requests and feedback

You can contact us from the app, from the shared card page or at [email protected]. We try to answer every message, but we do not guarantee a response time. Our support team cannot give medical advice and cannot tell you whether a meal is safe.

If you send us ideas, suggestions or food requests (“feedback”), you allow us to use them freely to improve SafeMeal, without any obligation or payment to you. Foods added to the catalog after a request belong to the catalog like any other entry.

10. Acceptable use

You agree not to:

  • use SafeMeal for any unlawful purpose or to harm, harass or deceive anyone;
  • copy, scrape, extract, sell or redistribute the catalog, the translations, the icons or any other part of SafeMeal’s content, or use them to build a competing product, except as these Terms allow;
  • reverse engineer, decompile or modify the app, except where the law expressly allows it despite this restriction;
  • get around the paid service, the store’s payment or any security or usage limit;
  • try to guess, collect or access other people’s share links, accounts or data;
  • send us content that is unlawful, infringing, abusive, or that contains malware, or overload or disrupt our services (including by automated messages);
  • present SafeMeal’s content as a medical or professional certification.

11. Our content and your licence

SafeMeal, including the app, the catalog, the translations, the card phrases, the icons, the illustrations, the name and the logo, belongs to Moty Studio or its licensors and is protected by intellectual property laws.

Subject to these Terms and, for the paid service, to a valid purchase, we give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on the devices you own or control, and to show, share and export your own cards, for your personal, non-commercial use. Restaurants and other people you show your card to may of course read it. Any other use needs our written permission.

The fonts and open-source software used in SafeMeal are subject to their own licences, which take precedence for those components.

12. Third-party services

SafeMeal relies on services provided by others, such as Apple, Google (including Firebase and Google Play), RevenueCat and Cloudflare, and works with your device’s operating system (for example for location, sharing and photos). Their terms and privacy policies apply to your use of them, and we are not responsible for them. The list of the service providers that process personal data for us is in our Privacy Policy.

13. Availability, changes and end of the service

We work to keep SafeMeal available and accurate, but we do not promise that it will always be available, free of errors, or compatible with every device or operating system version. We may interrupt it for maintenance, security or reasons beyond our control.

We may change SafeMeal. If a change significantly reduces the paid service you bought, we will tell you in advance in the app or by email when we have your address, and, where the law gives you that right, you may end your subscription and get a refund of the period not used.

We may stop providing SafeMeal. If we do, we will give you at least 60 days’ notice in the app or on safemeal.app when reasonably possible, and we will refund any prepaid, unused subscription period through the store where the store allows it or the law requires it.

14. Suspension and termination

You can stop using SafeMeal at any time, delete your account in the app, and cancel your subscription in your store account.

We may suspend or end your access to SafeMeal, or delete shared links, if you seriously or repeatedly breach these Terms, if the law requires it, or to protect other users, ourselves or third parties. Unless the law or a security reason prevents it, we will tell you why and give you a chance to respond. If we end your access without a valid reason, we will refund the paid service you lost.

Sections 2, 5 (last paragraph), 9 (feedback), 11, 15, 16, 17, 18 and 20 continue to apply after these Terms end.

15. Disclaimers

Section 2 explains the limits of SafeMeal. In addition, and to the fullest extent permitted by the law that applies to you:

TO THE FULLEST EXTENT PERMITTED BY LAW, SAFEMEAL AND ALL ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. MOTY STUDIO MAKES NO WARRANTY, EXPRESS OR IMPLIED, THAT ANY FOOD OR MEAL IS SAFE FOR YOU, THAT THE TRANSLATIONS, LISTS OR OTHER INFORMATION IN SAFEMEAL ARE ACCURATE, COMPLETE OR UP TO DATE, THAT ANY PERSON WILL READ, UNDERSTAND OR FOLLOW YOUR CARD, OR THAT SAFEMEAL WILL BE UNINTERRUPTED OR ERROR-FREE, AND DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We are not responsible for the acts, omissions, food or advice of restaurants, food businesses, manufacturers or any other third party, including anyone you show your card to.

Some jurisdictions do not allow certain warranties to be excluded. If you are a consumer, nothing in these Terms affects the warranties and guarantees that the law gives you and that cannot be excluded, such as the legal guarantee of conformity for digital content in the European Union.

16. Limitation of liability

What we never limit. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for our gross negligence or wilful misconduct, under product liability laws, or for any other liability that cannot be limited or excluded under the law that applies to you.

Subject to the paragraph above, and to the fullest extent permitted by law:

TO THE FULLEST EXTENT PERMITTED BY LAW, MOTY STUDIO, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OPPORTUNITY OR GOODWILL, ARISING OUT OF OR RELATED TO SAFEMEAL OR THESE TERMS, WHATEVER THE LEGAL THEORY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO SAFEMEAL OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR SAFEMEAL IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, AND (B) USD 100.

Your choices and third parties. To the extent permitted by law, we are not liable for any harm that results from food prepared or served by a third party, from your decision to eat a food, or from your failure to follow section 2 (for example not confirming with the staff or not carrying your prescribed medication), except to the extent the harm was caused by our breach of these Terms or our negligence.

If you are a consumer in the European Union, the European Economic Area, Switzerland or the United Kingdom, the two paragraphs above in capital letters and section 17 do not apply to you. Instead: we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or of our failure to use reasonable care and skill; we are not responsible for loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us when the contract was made. We provide SafeMeal for personal use only and are not liable to you for any business loss. Nothing in this section limits your statutory rights.

17. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Moty Studio from claims by third parties, and the related reasonable costs, arising from your breach of these Terms or your misuse of SafeMeal, including information you entered about other people or cards you shared without permission. This section does not apply to consumers in the European Union, the European Economic Area, Switzerland or the United Kingdom.

18. Governing law and disputes

18.1 Talk to us first

Most problems can be solved quickly. Before starting any claim, please write to [email protected] with your name, the email or account involved, a description of the problem and what you are asking for. Both of us agree to try in good faith to resolve the dispute informally for 60 days after we receive your message.

18.2 Governing law

These Terms are governed by the laws of the State of Wyoming, United States, and applicable U.S. federal law, without regard to conflict-of-law rules. If you are a consumer living outside the United States, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your country of residence. If you live in the EU, you may also contact your national consumer protection authority or a consumer dispute resolution body.

18.3 Arbitration (users in the United States only)

This section affects your rights. Please read it carefully.

If you live in the United States, you and Moty Studio agree that any dispute, claim or controversy arising out of or relating to SafeMeal or these Terms that is not resolved under section 18.1 will be resolved by binding individual arbitration, and not in court, except that (a) either of us may bring an individual claim in small claims court if it qualifies, and (b) either of us may ask a court for an injunction to stop the infringement or misuse of intellectual property.

  • The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, before a single arbitrator. The arbitrator decides all questions, including the scope and enforceability of this section, except that a court decides questions about the class action waiver and section 18.4.
  • The hearing will take place by videoconference or in the county where you live, unless both of us agree otherwise. We will pay the filing, administrative and arbitrator fees beyond the amount you would pay to file a claim in court, unless the arbitrator finds your claim frivolous.
  • Class action waiver: you and Moty Studio may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may award relief only to you individually. If this waiver is found unenforceable for a claim, that claim (and only that claim) will be decided in court, after any individual arbitration is complete.
  • You and Moty Studio waive any right to a jury trial.
  • Opt-out. You may opt out of this arbitration agreement within 30 days after you first accept these Terms by writing to [email protected] with the subject “Arbitration opt-out”, your name and the email or account you use with SafeMeal. Opting out does not affect the rest of these Terms.

18.4 Mass filings

If 25 or more similar claims are filed against us by or with the help of the same lawyers or organizations, they will be administered in batches of up to 25 claims, one batch at a time, and the AAA’s mass arbitration supplementary rules will apply. The limitation periods for claims waiting in a later batch are suspended until their batch starts.

18.5 Courts

Except for arbitration under section 18.3 and claims a consumer brings in their own country under section 18.2, any action relating to these Terms will be brought exclusively in the state or federal courts located in Wyoming, and you and we consent to their jurisdiction.

19. Additional terms for the Apple App Store

If you downloaded SafeMeal from the Apple App Store, the following also applies:

  • These Terms are between you and Moty Studio only, not Apple. Moty Studio, not Apple, is solely responsible for SafeMeal and its content.
  • Your licence to use SafeMeal is limited to Apple-branded products that you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions, except that SafeMeal may also be accessed by other accounts associated with you through Family Sharing or volume purchasing where available.
  • Apple has no obligation to provide any maintenance or support services for SafeMeal.
  • If SafeMeal fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of SafeMeal, if any, to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to SafeMeal. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Moty Studio’s responsibility, to the extent these Terms do not exclude it.
  • Moty Studio, not Apple, is responsible for addressing any claims by you or a third party relating to SafeMeal or your possession and use of it, including product liability claims, claims that SafeMeal fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation.
  • If a third party claims that SafeMeal or your possession and use of it infringes their intellectual property rights, Moty Studio, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms (such as your mobile carrier’s) when using SafeMeal.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

20. General

  • Changes to these Terms. We may update these Terms, for example when SafeMeal or the law changes. We will post the new version on this page with its effective date and, for a change that materially affects your rights, tell you in the app at least 30 days before it takes effect (unless the change is required sooner by law or for security). If you do not agree with the change, you can stop using SafeMeal, delete your account and cancel your subscription before it takes effect; if you keep using SafeMeal after that date, the new Terms apply.
  • Entire agreement. These Terms, together with any terms shown to you at a purchase, are the whole agreement between you and us about SafeMeal.
  • Severability. If any part of these Terms is found invalid or unenforceable, the rest stays in force, and the invalid part is replaced by the valid provision closest to its intent.
  • No waiver. If we do not enforce a right immediately, we do not give it up.
  • Assignment. You may not transfer your rights under these Terms. We may transfer them to a company that takes over SafeMeal, provided your rights are not reduced; we will tell you if this happens.
  • Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
  • Language. These Terms are written in English. If we provide a translation, it is for convenience only and the English version prevails, except where the law of your country requires otherwise.
  • Notices. We may contact you in the app, on safemeal.app, or by email when we have your address; these electronic notices count as written notice. You can contact us at the address below.
  • Export. You may not use or export SafeMeal in violation of U.S. or other applicable export control and sanctions laws.
  • California users. Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
